These Terms apply to schools, academy trusts, local authorities, and individual teachers purchasing or using our Services.
3. Our Services
We provide access to digital educational resources, tools, and subscription services delivered online.
4. Accounts and Access

Teacher accounts are responsible for managing any student accounts created.

Schools and teachers must keep login details secure.

Access must not be shared outside the purchasing organisation or individual.
5. Licence to Use Our Content

We grant a non-exclusive, non-transferable licence to use our content for internal educational purposes.

Content must not be resold, redistributed, or made publicly available.
6. Subscriptions and Payments

Payments are processed via third-party providers including Wix and PayPal.

Subscription fees are charged in advance for the stated term.

We may update pricing with reasonable notice.
7. Refunds and Cancellations
Due to the digital nature of our Services, no refunds are offered once access has been provided, except where required by law.
8. Acceptable Use

Users must not misuse the Services or attempt to bypass security.

The Services must not be used for unlawful purposes.
9. Suspension or Termination
We may suspend or terminate access where there is misuse, non-payment, or breach of these Terms.
10. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
Subject to the above, our total liability to you, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees paid by you in the 12 months preceding the claim.
We shall not be liable for any indirect or consequential loss, including loss of profits, loss of data, loss of business, or business interruption.
11. Service Availability and Performance
We aim to provide a reliable and high-quality service but do not guarantee that the Services will be uninterrupted, error-free, or available at all times.
We may suspend or restrict access to the Services for maintenance, updates, or technical reasons.
We do not guarantee that the Services will meet all specific requirements of the customer.
12. Governing Law
These Terms are governed by the laws of England and Wales.
Digital Content – No Right to Cancel
Due to the nature of digital content, once access to digital resources or subscriptions has been provided, you will not have a right to cancel or receive a refund, except where required by law.
By purchasing digital content or a subscription, you acknowledge and agree that access will begin immediately upon purchase and that you therefore lose your statutory right to cancel under the Consumer Contracts Regulations once access has started. This does not affect any statutory rights you may have in relation to faulty digital content.
13. Data Security and Backups
We implement appropriate technical and organisational measures to protect personal data processed through our Services. Live platform data is hosted on secure servers within the European Union.
Encrypted backup copies of platform data may be stored using secure cloud storage providers. All backup data is encrypted prior to transfer and remains inaccessible without the encryption key, which is retained solely by Primary Solutions.
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control.
Such events may include (but are not limited to) internet outages, hosting or infrastructure failures, cyber incidents, power outages, or other events beyond our control.
